On 22 May 2023 the Court of Bosnia and Herzegovina issued a Decision in the case of Sead Kukuljac et al. (S1 2 K 045702 23 Krn) whereby it granted the Prosecutor’s Motion dated 22 May 2023 and ordered custody of the suspects Sead Kukuljac and Sead Muslić, which under the Decision may last for a maximum of one month running from the day of arrest, which means until 20 June 2023 or pending a new decision of the Court.
The suspects were ordered in custody on grounded suspicion that they committed the criminal offense of Organized Crime under Article 250, Paragraphs 1 and 3, of the Criminal Code of Bosnia and Herzegovina (CC BiH) as read with the criminal offense of Illicit Trafficking in Narcotic Drugs under Article 195(1) CC BiH, as well as on particular custody grounds referred to in Article 132(1)b) of the CPC BiH, which is the concern that they may destroy, conceal, alter or forge the evidence or clues important for the criminal proceeding, interfere with the witnesses, accomplices and accessories, and in relation to the suspect Sead Kukuljac also on particular custody grounds referred to in Article 132(1)c) CPC BiH, which is the concern that the suspects may repeat or complete the criminal offense.
